Privacy Policy 

This Privacy Policy describes how Mercury Analytics LLC, and its affiliates (collectively, the “Company,” “we,” or “us”) use the Personal Information that we collect from or about you, both online through the websites, applications, and electronic communications from which it is linked (the “Platform”) and through our “offline” activities, such as via our focus groups.  Our online and offline activities are collectively referred to as the “Services.”

Personal Information We Collect

We, and our service providers, may collect Personal Information from you in a variety of ways, including, but not limited to, when you visit or register on our Platform, subscribe to the newsletter, respond to a survey, fill out a form, participate in a focus group, and in connection with other activities, services, features or resources we make available you . You may be asked for, as appropriate, name, email address, mailing address, phone number. You may, however, visit our Site anonymously. You can always refuse to supply Personal Information to us, except that it may prevent you from engaging in certain Platform related activities.

In addition to the Personal Information described above, we may automatically collect certain information about you whenever you interact with our Platform. This information may include your IP address, browser type and version, operating system, device ID and type, your location, and other information about how you use and access our Platform.

Cookies and Other Technologies

Our Site may use “cookies” and other similar technologies to enhance your experience and to understand your browsing experience.  Third parties may also use cookies and other tracking technologies to collect information about you when you use our Platform.  They may use this information to provide you with interest based advertising or other targeted content.  You can adjust your cookie preferences via your web browser, but please note that if you do so some parts of the Platform may not function properly.

How we use Personal Information

We may collect and use your Personal Information for a number of purposes, including:

  • To provide our Services

  • To improve customer service

  • To respond to your customer service requests and support your needs more efficiently.

  • To personalize your user experience

  • We may use information in the aggregate to understand how our users as a group use the Services and our Platform

  • To improve our Platform

  • We may use feedback you provide to improve our Services

  • In anonymous form, to share survey information received from you and other third parties

  • When we execute a research study, we collect the opinions of those that participate in the study, and we share those opinions in aggregate, anonymous, form with the responses of others who participated in that research study

  • To run a focus group in which you have agreed to participate, to send you reminders in connection with your participation in such groups, to reward you for your participation in such groups, and to contact you if there are any follow-up questions regarding your participation in the group

  • To run a promotion, contest, survey or other Platform feature

  • To send you information you have agreed to receive

We may use your email address to respond to your inquiries, questions, and/or other requests. If you decide to opt-in to our mailing list, you will receive emails that may include company news, updates, related product or service information, etc. If at any time you would like to unsubscribe from receiving future emails, we include detailed unsubscribe instructions at the bottom of each email.

Sharing Personal Information

In almost all cases, your participation in research studies executed by our company is anonymous and we will not know your Personal Information. In a small number of online surveys or if you sign-up to participate in an online Live Labs focus group, we may ask for your Personal Information. In that case, we may share your Personal Information in the following ways and with the following third parties:

  • Internally within our corporate family. We may share your Personal Information with our subsidiaries and affiliates.

  • Our Service Providers. We may share your Personal Information with contractors, service providers and other third parties that we use to support our business, including IT services, data storage and hosting platforms, and other similar entities.

  • Our Clients and Partners. If you participate in a survey or focus group that requests your Personal Information, the specific reasons that we need your Personal Information will be explained prior to your providing such information and you can elect to not supply such information and to not participate in the research. If you do provide such information, we may share your Personal Information with customers involved in such projects.

  • Companies involved in Mergers and Acquisitions. To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of the Company’s assets, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding, in which Personal Information held by the Company about our Platform’s users is among the assets transferred. You acknowledge that such transfers may occur, and that any parties who acquire us may continue to use your Personal Information according to this Privacy Notice.

  • Fraud and Other Financial Investigations. We may share your information in the course of an investigation or prevent a violation by you related to fraud, illegal or harmful activity, or contractual violation.

  • Law Enforcement, Government Agencies, and Courts. We may disclose Personal Information at the request of law enforcement or government agencies or in response to subpoenas, court orders, or other legal process to establish, protect, or exercise our rights or to defend against a legal claim or as otherwise required or allowed by law, or to protect the rights, property, or safety of any other person.

How we protect your Personal Information

We have implemented reasonable measures designed to secure your Personal Information from accidental loss and from unauthorized access, use, alteration and disclosure.

Unfortunately, the transmission of information via the Internet is not completely secure. Although we do our best to protect your Personal Information, we cannot guarantee the security of your Personal Information transmitted to us via the Internet, including to our Platform. Any transmission of Personal Information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Platform.

Third party websites

We do not control the practices employed by websites linked to or from our Site. In addition, these sites or services, including their content and links, may be constantly changing. These sites and services may have their own privacy policies and customer service policies. Browsing and interaction on any other website, including websites which have a link to our Site, is subject to that website’s own terms and policies.

Compliance with children’s online privacy protection act

Protecting the privacy of children is especially important. For that reason, we never knowingly collect or maintain Personal Information from children under the age of 13, and no part of our website is structured to attract anyone under 13.

California Privacy Rights

Pursuant to the California Consumer Privacy Act of 2018 (“CCPA”), California residents have certain other rights concerning their Personal Information.  This section describes (a) the categories of Personal Information we collect and disclose, (b) your privacy rights under the CCPA, and (c) how to exercise your rights under the CCPA.

When we use the term “Personal Information” in this section, we mean information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household.

Personal Information We Collect

If you are a California consumer, please be aware that we collect, process, and maintain Personal Information to fulfill certain business purposes related to our Services. We will not collect additional categories of Personal Information or use Personal Information collected for additional purposes without providing you notice.  Within the past twelve (12) months we and our service providers have collected, and we may continue to collect, and you may consent to provide, the categories of Personal Information set forth below.  We disclose each of these categories of Personal Information with our service providers for our business purposes (to enable the service providers to provide their services) and as otherwise described in this Privacy Policy.

  • Identifiers (for example, name, date of birth, email address, IP address, and online identifiers);

  • Categories of Personal Information as defined by Cal. Civ. Code § 1798.80 (for example, name and telephone number);

  • Protected classifications under California or federal law (for example, age, citizenship status, national origin or ancestry);

  • Commercial information (for example, records of products or services purchased);

  • Internet or other electronic network activity information, including information on your usage of our Platform;

  • Geolocation data;

  • Audio or electronic information (for example, videos you may upload to our Platform);

  • Professional or employment related information;

  • Education information; and

  • Inferences drawn from any information identified above to create a profile.

Your Privacy Rights

In accordance with the CCPA, California consumers may, under certain conditions, exercise the following privacy rights with respect to their Personal Information.

Privacy Rights & Descriptions

  • Notice: You have the right to be notified of what categories of Personal Information will be collected at or before the point of collection and the purposes for which they will be used and shared.

  • Access: You have the right to request the categories of Personal Information that we collected in the previous twelve (12) months, the categories of sources from which the Personal Information was collected, the specific pieces of Personal Information we have collected about you, and the business purposes for which such Personal Information is collected and shared. You also have the right to request the categories of Personal Information which were disclosed for business purposes, and the categories of third parties to whom the disclosures were made, in the twelve (12) months preceding your request for your Personal Information.

  • Data Portability: You have the right to receive the Personal Information you have previously provided to us.

  • Erasure: You can request to have your Personal Information deleted from our systems and those of our service providers. However, please be aware that we may not fulfill your request for deletion if we (or our service provider(s)) are required to retain your Personal Information for one or more of the following purposes: (1) to complete a transaction for which the Personal Information was collected, provide a good or service requested by you, or complete a contract between us and you; (2) to ensure our website integrity, security, and functionality; (3) to comply with applicable law or a legal obligation, or exercise rights under the law (including free speech rights); (4) to otherwise use your Personal Information, internally, in a lawful manner that is compatible with the context in which you provided it.

  • To Opt Out: We do not sell Personal Information to third parties.

How to Exercise Your Rights

While we take measures to ensure that those responsible for receiving and responding to your request are informed of your rights and how to help you exercise those rights, when contacting us to exercise your rights, we ask you to please adhere to the following guidelines:

  • Tell Us Which Right You Are Exercising: Specify which right you want to exercise and the Personal Information to which your request relates. If you are acting on behalf of another consumer, please clearly indicate this fact and your authority to act on such consumer’s behalf;

  • Help Us Verify Your Identity: If you are emailing or calling us, please provide us enough information to verify your identity. For example, provide us (at a minimum) your full name, address, email, phone number, and date of birth. Please note that if we cannot initially verify your identity, we may request additional information to complete the verification process. Any Personal Information you disclose to us for purposes of verifying your identity will solely be used for the purpose of verification.

  • Direct Our Response Delivery: Inform us of the delivery mechanism with which you prefer to receive our response. You may specify, for example, email, mail, or through your account (if you have one with us).

Please note that you don’t need to create an account with us in order to make a request to exercise your rights hereunder.

How We Respond to Your Requests

In all cases, we will respond to your request within 45 days. However, where reasonably necessary, we may extend our response time by an additional 45 days, provided we send you notice of such extension first. We will provide the information to you via your preferred delivery mechanism.  If the information is provided to you electronically, we will provide you the information in a portable format and, to the extent technically feasible, in a machine readable, readily useable format that allows you to freely transmit this information without hindrance.

Please note that we will not charge you for making a request, provided that you make no more than two (2) requests per year. If you make three (3) or more requests in any given twelve (12) month period, we may refuse to respond to such requests, if determined by us to be unfounded or excessive (e.g. repetitive in nature), or we may charge a reasonable fee taking into account the administrative costs of providing the information or communication or taking the action requested. If we refuse to act on the request, we will provide you notice and the reason for our refusal to act.

Changes to this privacy policy

We have the discretion to update this privacy policy at any time. When we do, we will revise the updated date at the bottom of this page.  If we make material changes to how we treat your Personal Information, we will notify you by email to the most recent email address provided to the Company, or through a notice via pop-up window on the Platform’s home pages. We encourage you to frequently check this page for any changes to stay informed about how we are helping to protect the Personal Information we collect. It is your responsibility to review this Privacy Policy periodically and become aware of modifications.
